Why classification matters

The selected tariff provision can affect the ordinary duty rate, additional tariff treatment, eligibility for exclusions, Partner Government Agency requirements and the information that should support the entry.

What a useful classification review needs

  • A precise description of the product and its function.
  • Materials or composition where relevant.
  • Technical specifications, brochures, photographs or drawings.
  • How the product is sold and used.
  • Country of origin and manufacturing facts when relevant to the question.

When greater certainty may be appropriate

CBP's Binding Ruling Program allows importers and other interested parties to seek pre-entry decisions on classification and other import questions. For recurring products or material classification uncertainty, a ruling strategy may be worth considering.
